Title 5 is Massachusetts code 310 CMR 15.000.
It governs the regulation of wastewater disposal
where municipal sewers do not exist. Simply
stated, Title 5 regulates individual septic systems.
This code sets the minimum standards by which
septic systems in Massachusetts are designed,
constructed, inspected and maintained. Individual
towns may enhance the state minimum standards
with regulations of their own; however,
town regulations may not be less restrictive than the standards
set by the state.
The Title 5 code plays an important part in
maintaining the public health and protecting
the environment. The code sets the standards
by which wastewater is treated at the residential
and commercial levels where municipal sewers
do not exist. These standards protect individuals,
wildlife and wetland areas, and groundwater
from the hazards associated with wastewater.
